Terms and Conditions

These Terms and Conditions define the conditions under which YProject-IT provides consulting, support, training and assistance services to professionals. Services are provided exclusively for professional clients.

Services offered

YProject-IT works in particular in the following areas:

  • strategic scoping;
  • governance and steering;
  • project management;
  • program structuring;
  • transformation support;
  • decision support;
  • PMO;
  • audit and diagnostic;
  • support for leaders and project managers;
  • professional training.

The list of services presented on the website is indicative and non-exhaustive.

Services

Each service is subject to a quotation, commercial proposal or service contract.

The order is considered firm from the signature of the quotation, the signature of the contract or written acceptance of the proposal.

Prices and payment

Prices are expressed in euros.

Unless otherwise stated, prices are exclusive of tax. Any travel, accommodation or meal expenses are billed in addition. Applicable prices are those shown on the accepted quotation. Unless otherwise specified in the quotation, a 30% deposit is requested upon order, with the balance due upon receipt of invoice. Payment is made by bank transfer or by any other means accepted by YProject-IT. In the event of late payment, late-payment penalties are automatically payable.

A fixed recovery fee of €40 is also due in accordance with Article D.441-5 of the French Commercial Code.

YProject-IT reserves the right to suspend performance of the services until all amounts due have been paid in full. Any request for postponement or cancellation must be made in writing.

Unless otherwise agreed, cancellation more than 15 days before the intervention is free of charge. Cancellation between 15 and 7 days before the intervention results in billing of 50% of the planned amount. Cancellation less than 7 days before the intervention results in billing of 100% of the planned amount.

Confidentiality

Data collected through the website or during assignments is used exclusively for managing commercial relations, performing services and professional communication.

They are neither sold nor transferred to third parties. Information exchanged during assignments is considered confidential and may not be disclosed to third parties without prior agreement. Unless the client objects in writing, YProject-IT may mention the client’s name as a commercial reference. The client agrees to provide the information necessary to carry out the assignment, designate the relevant contacts, facilitate access to useful information and participate in planned meetings or workshops.

The client remains solely responsible for decisions made following the recommendations provided. YProject-IT undertakes to implement all reasonable means necessary to carry out the assignment.

Services are subject to an obligation of means and not an obligation of result. Each party undertakes to keep strictly confidential the information obtained during the assignment. This obligation remains applicable for five years after the end of the service.

Applicable law

These Terms and Conditions are governed by Czech law. The methodologies, models, tools, teaching materials, documents, frameworks and content developed or used by YProject-IT remain its intellectual property.

The client has an internal right of use for the needs of their organization.

Any reproduction, distribution or commercialization without written authorization is prohibited.

Training

When the service includes training, the participant undertakes to comply with the communicated operating rules.

Materials provided remain protected by intellectual-property rights. Training sessions may not be recorded, reproduced or redistributed without written authorization.

Liability

YProject-IT may only be held liable in the event of proven fault.

In any event, YProject-IT’s total liability is limited to the amount of the service concerned.

YProject-IT may not be held liable for indirect losses, operating losses, loss of revenue or consequences related to decisions made by the client. No party may be held liable in the event of force majeure within the meaning of applicable regulations.
